Aggravated Sexual Assault


An aggravated sexual assault is one that occurs under particularly violent circumstances.  It may involve a weapon, the threat of death, or an elderly or particularly young victim.  Aggravated Sexual Assault is considered a first degree felony and can result in punishment of five to 99 years in prison, up to a $10,000 fine.  In cases of Aggravated Sexual Assault, probation is not an option as an alternative to prison.

Texas law states that aggravated sexual assault includes sexual assaults involving:

Serious bodily injury or death to the alleged victim or witness

Threats of serious bodily injury, death, or kidnapping

The use of a deadly weapon

The use of known “Date Rape drugs” or other chemicals or controlled substances without the alleged victim’s knowledge

More than one person acting in concert with another toward the same victim and occurring during the course of the same criminal episode

A minor under the age of 14
